1. Acceptance of Terms

By accessing or using Findy ("the Service"), operated by Findy ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Findy is an AI-powered omnichannel customer communication platform that unifies conversations from WhatsApp, Instagram, Email, Telegram, and other messaging channels into a single inbox. The Service includes AI-assisted responses, automation, analytics, and team collaboration tools.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Billing

  • Free Trial: New accounts receive a 14-day free trial. No credit card is required to start.
  • Paid Plans: After the trial, continued access requires a paid subscription. Pricing is listed on our Pricing page.
  • Billing Cycle: Subscriptions are billed monthly or annually in advance. Annual plans receive a discount.
  • Cancellation: You may cancel at any time. Your account remains active until the end of the current billing period. No refunds for partial periods.
  • Price Changes: We may adjust pricing with 30 days' notice. Existing subscriptions are honored until renewal.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk commercial communications.
  • Violate any applicable law, regulation, or third-party rights.
  • Transmit malware, viruses, or any harmful code.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Use the Service for any illegal, harassing, or abusive purpose.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Data Ownership

  • Your Data: You retain all rights to the data you submit to the Service, including customer conversations, contacts, and uploaded content.
  • Our License: You grant us a limited license to process your data solely to provide the Service.
  • Data Export: You may export your data at any time through the platform or by contacting support.
  • Data Deletion: Upon account termination, we will delete your data within 30 days, unless required by law.

7. AI Features

The Service includes AI-powered features ("Captain AI") that generate automated responses and suggestions. AI outputs are provided "as is" and may not always be accurate. You are responsible for reviewing and approving AI-generated content before it reaches your customers. We do not use your conversation data to train external AI models.

8. Third-Party Integrations

The Service integrates with third-party messaging platforms and tools. Your use of these integrations is subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Service Availability

We target 99.9% uptime for paid plans. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Findy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Findy harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of New Delhi, India.
